5. WARRANTIES AND PROCEDURE FOR REVIEWING CLAIMS
The Seller’s warranty obligations comply with the legislation of Ukraine and arise from the moment the goods are transferred.
The warranty period for the goods is specified in the warranty card. The Seller guarantees the operability of the goods in accordance with their technical characteristics throughout the entire warranty period, except in cases of damage related to non-compliance with assembly conditions, storage conditions and violation of operating conditions.
The Seller provides a warranty for the goods for a period of 6 months from the moment of actual receipt of the goods.
The warranty period for a component product is equal to the warranty period for the main product and begins at the same time.
If the Buyer discovers defects in the goods during the warranty period, the Buyer has the right:
to a proportional reduction in the price of the goods;
to free elimination of defects in the goods within a reasonable period;
to reimbursement of expenses for eliminating defects in the goods — if such independent elimination was agreed with the Seller.
Independent elimination of defects in the goods by the Buyer without agreement with the Seller releases the Seller from warranty obligations.
In the event of a substantial violation of the quality requirements for the goods, the Buyer has the right, at their choice:
to withdraw from the agreement and demand the return of the amount paid for the goods;
to demand replacement of the goods with an identical product.
If substantial/hidden defects of the goods are discovered after acceptance of the goods, the Buyer is obliged to notify the Seller of such defects no later than the next working day from the date of their discovery.
Delivery of the goods for elimination of defects to the nearest Seller’s warehouse during the warranty period or after the warranty period is carried out in accordance with the Law of Ukraine “On Consumer Rights Protection”.
Review of the Buyer’s claims is carried out in accordance with Articles 7 and 8 of the Law of Ukraine “On Consumer Rights Protection” and the Procedure for repair (maintenance) or warranty replacement of technically complex household goods, approved by Resolution of the Cabinet of Ministers of Ukraine dated 11.04.2002 No. 506.
The color of the goods may differ from the original depending on the image transmission specifics of the Buyer’s monitor, as well as depending on the properties of the materials used by the manufacturer.
6. PROCEDURE FOR EXCHANGE AND RETURN OF GOODS OF PROPER QUALITY
In accordance with the Law of Ukraine “On Consumer Rights Protection”, the Buyer has the right to exchange a non-food product of proper quality for an identical one from the seller from whom it was purchased, if the product did not satisfy the Buyer by shape, dimensions, style, color, size or for other reasons cannot be used by the Buyer for its intended purpose.
The Buyer has the right to exchange goods of proper quality within fourteen days, not counting the day of purchase.
Exchange of goods of proper quality is carried out if:
the goods were not used and their marketable appearance and consumer properties have been preserved;
the goods were not assembled and were not installed;
the complete set of the sold goods has been preserved;
the factory packaging, marking, films, stickers, seals and labels have been preserved;
the goods do not contain scratches, chips, abrasions and are fully operational;
the integrity of both the goods and their components has not been violated;
the settlement document issued to the Buyer together with the sold goods, or the QR code displayed on the screen of the software registrar of settlement operations (the display of the device on which the software registrar of settlement operations is installed), which allows the Buyer to read and identify it with the settlement document according to the data structure contained therein, or the electronic settlement document sent to the subscriber number or email address provided by the Buyer.
If the goods do not meet the conditions specified in clause 6.3 of the Agreement, the Seller has the right to refuse the exchange of the goods.
If, at the time of exchange, an identical product is not available for sale, the Buyer has the right either to purchase any other goods from the available assortment with the appropriate recalculation of the cost, or to terminate the agreement and receive back the money in the amount of the value of the returned goods, or to exchange the goods for an identical product upon the first arrival of the corresponding product for sale. The Seller is obliged to notify the Buyer requesting the exchange of the goods on the day the goods arrive for sale.
When goods are exchanged, their warranty period is calculated anew from the day of exchange.
Goods manufactured according to an individual order, including in a certain fabric, in certain non-standard dimensions, in certain colors, etc., are not subject to exchange or return.
The cost of delivery and additional related works/services at the place of delivery, which was paid by the Buyer, is not refundable in the event of the Buyer exchanging the goods and returning them to the Seller.
Transport costs for the delivery of goods during their exchange are borne by the Buyer.
