Excerpt from the public agreement, sections 2 and 3
COST OF GOODS AND PROCEDURE FOR PAYMENT OF THEIR COST.
The cost of the goods is the sum of individual items reflecting the prices on the Website and constitutes the order amount. The cost of the goods does not include the cost of delivery and additional related works/services at the place of delivery. The cost of delivery and additional related works/services is agreed by the parties separately, in accordance with the information indicated on the Website. Prices for Goods and services are determined by the Seller independently and are indicated on the online store website. All prices for Goods and services on the website are indicated in hryvnias, including VAT.
The final cost of the Buyer’s order is indicated in the invoice, while the cost of the goods selected by the Buyer may differ from the price of such goods indicated on the Seller’s Website and may be determined taking into account the specifics of the Buyer’s order.
The price of the goods is indicated on the Website in the national currency of Ukraine (hryvnia) per unit of goods according to the established price list. The Seller reserves the right to change the price of the goods before the order is placed without prior notice to the Buyer.
The Buyer has the right to confirm or cancel the order for the purchase of goods if the price is changed by the Seller after the order has been placed.
Payment for the cost of the order is made by the Buyer on the terms of full prepayment of the Buyer’s order within 3 (three) working days from the moment the Buyer receives the invoice or by using the LiqPay payment system.
The Agreement is considered concluded from the moment the full amount of the order cost is paid, and from this moment the Seller’s contractual obligations arise.
The date of payment by the Buyer for the order cost is considered to be the date of receipt of the corresponding amount of funds to the Seller’s current account or to the LiqPay payment system..
Settlements between the Parties regarding the terms of this Agreement are carried out in the national currency of Ukraine by transferring the corresponding amount of money by the Buyer to the Seller’s current account in accordance with the bank details specified in the Seller’s invoice or by using the LiqPay payment system.
DELIVERY OF GOODS
Delivery of the ordered goods is carried out according to the terms specified on the Website in the “Delivery” “Payment” sections.
Delivery of the goods may be carried out directly by the Seller or by a courier or forwarding service, as well as independently by the Buyer from the Seller’s warehouse, (pickup).
In the case of delivery of the goods by the Seller, responsibility for the preservation of the goods until the moment of their transfer to the Buyer is borne by the Seller.
In the case of delivery of the goods by a courier or forwarding service, responsibility for the preservation of the goods until the moment of their transfer to the Buyer is borne by the courier or forwarding service. The moment of shipment of the goods to the Buyer is the moment of their transfer to the courier or forwarding service.
The Seller undertakes to deliver the goods to the Buyer within the period agreed with the Buyer. The place of delivery of the goods is indicated by the Buyer when placing the order for the purchase of the goods.
Ownership of the goods passes to the Buyer at the moment of transfer of the goods to the courier or forwarding service or upon independent pickup of the goods by the Buyer from the Seller’s warehouse.
In the case of independent delivery of the goods by the Seller, the goods are transferred to the Buyer, and in the absence of the Buyer - to any person who presents a receipt or other document confirming the conclusion of the Agreement or the arrangement of delivery of the goods. From the moment of such transfer, ownership of the goods passes to the Buyer.
At the moment of transfer of the goods to the Buyer, documents confirming payment and transfer of the goods, as well as warranty documents, if such are provided for by the characteristics of the goods, are handed over.
For each failed delivery, the Buyer additionally pays an amount equal to the cost of delivery; further delivery terms are determined by the Seller.
Fulfillment of the order by the Seller begins on the next day after payment for the goods by the Buyer and presentation of confirming documents on such payment.
Before delivering the goods to the Buyer, employees of the online store “https://mebwood.com” and/or the courier, and/or a third party delivering the ordered goods on behalf of the Seller, have the right to require the Buyer to provide a document confirming the fact of payment for the goods (order).
When receiving the goods at the carrier’s warehouse, from the courier or from the Seller, the Buyer is obliged to check the external integrity of the packaging, then open it and directly make sure that the goods are in proper external condition (absence of mechanical damage) and that the set is complete.
If at least one of the listed defects is present, the Buyer is obliged to record it in an act drawn up in any form. The act must be signed by the Buyer and an employee of the carrier or the Seller. The defects must be recorded by means of photo or video shooting. Within 1 (one) working day, the Buyer is obliged to notify the manager, (the Seller’s representative responsible for processing the order for the goods), of the detected defects and describe them in detail.
The pattern of the wood structure and any color contrasts related to the physical characteristics of the wood species are not considered defects of the goods.
The Parties agreed that in the event of non-compliance with the mandatory requirements specified in clauses 3.11-3.12 of this Agreement, the goods shall be deemed received by the Buyer in proper condition – without any mechanical damage and in full completeness.
